ELIGIBILITY: The Create Your Own Subscription Sweepstakes (the “Sweepstakes”) is open and offered only to legal residents of the 50 United States of America and Washington D.C. who are at least 21 years of age or older at the time of entry. Employees and volunteers of Carnegie Hall, their immediate families (parent, child, sibling or spouse) and/or household members and any other persons employed by, or volunteering with, entities associated with this promotion are ineligible to enter or win. Void in Puerto Rico and where prohibited by law.

ADMINISTRATOR: The administrator of the sweepstakes is the Carnegie Hall Marketing and Creative Services Department, Carnegie Hall, 881 Seventh Avenue, New York, NY 10019 (the "Administrator").

AGREEMENT TO OFFICIAL RULES: By participating, entrants agree to abide by and be bound by these Official Rules and the decisions of the Administrator, which are final and binding in all matters relating to the Sweepstakes. Winning any prize is contingent upon fulfilling all requirements set forth herein.

HOW TO ENTER: The Sweepstakes begins at 9 AM Eastern Time (“ET”) on April 10, 2024 and ends at 11:59 PM ET on April 28, 2024 (“Sweepstakes Period”). Once entrants have accessed the application, they need to enter their name, address, email address, and submit the completed entry form. Limit: One (1) entry per person and per email address will be permitted during the Sweepstakes Period. The Sponsor and Administrator are not responsible for late, incomplete, misdirected, or delayed entries, including any internet failure. Incomplete information may result in disqualification of entry. Entries generated by script, macro, robotic, programmed, or any other automated means are prohibited and will be disqualified. No mechanical reproductions or facsimiles of entries are allowed. All entries become the exclusive property of Sponsor/Administrator and will not be acknowledged or returned.

The Administrator is not responsible for late, incomplete, misdirected, or delayed entries, including due to any internet failure. Incomplete information may result in disqualification of entry. DRAWING AND NOTIFICATION: One (1) Grand Prize Winner ("Grand Prize Winner") will be selected in a random drawing from among all eligible entries received at the end of the Sweepstakes Period. The drawing will be conducted on or about May 1, 2024 by the Administrator. Odds of winning will depend on the total number of eligible entries received. Each Winner will be contacted via the email address or phone number provided in such Winner's entry form.

PRIZE: One (1) Grand Prize Winner will receive a Create Your Own Subscription, which includes 2 tickets to 4 concerts of your choice during the 2024-2025 Concert Season at Carnegie Hall, for a total of 8 tickets. Approximate Retail Value ("ARV") of the Grand Prize is up to $1,000.

PRIZE CONDITIONS: By participating in the Sweepstakes, including by accepting any Prize, the Winners agree to release the Administrator from any and all liability whatsoever for any injuries, losses, or damages of any kind caused by or related to entering the promotion, or from acceptance, possession, or use/misuse of prize awarded. All local, state and federal taxes and/or any other fees/costs associated with the receipt of any prize are solely the responsibility of the winner. No substitution or transfer of prize or election of cash in lieu of prize will be permitted. Each Prize winner will be required to complete and return the following forms, to be provided by Administrator, within ten (10) days of written notification or the Prize may be forfeited and an alternate winner selected: (i) an Affidavit of Eligibility and Liability/Publicity Release which will, among other items, allow the Administrator to use the name and likeness of the Prize Winner, and (ii) a W-9 form. All federal, state or other tax liabilities arising from the Sweepstakes will be the responsibility of the winners, and the Administrator will have no responsibility or liability related thereto. The Administrator reserves the right to, at its sole discretion, substitute any prize package with another prize of equal or greater value in the event that any of the Prizes (or any component thereof) is not available. If a Prize or Prize notification is returned as unclaimed or undeliverable to a potential Winner, if a potential Winner cannot be reached within three (3) calendar days from the first notification attempt, or if a potential Winner fails to return requisite documents within the specified time period, or if a potential Winner is not in compliance with these Official Rules, then such person will be disqualified and an alternate Winner will be selected for the prize at issue. All taxes, if applicable, are the sole responsibility of the appropriate Winner. Each Winner’s entry, and acceptance of the Prizes offered, constitutes permission (except where prohibited) for the Administrator to use such Winner’s name, photograph, likeness, statements, biographical information, voice and address (city and state), in all forms of media, in perpetuity, without notice or further compensation.

GENERAL CONDITIONS: If for any reason the operation or administration of this Sweepstakes is impaired or incapable of running as planned for any reason, including but not limited to (a) infection by computer virus, bugs, (b) tampering, unauthorized intervention, (c) fraud, (d) technical failures, or (e) any other causes beyond the control of the Administrator which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes, the Administrator reserves the right to, at its sole discretion and without notice, cancel, terminate, modify or suspend this Sweepstakes in whole or in part and not award any Prizes or take such other steps that are fair and equitable and best conforms to the spirit of these Official Rules. The Administrator reserves the right to, at its sole discretion, disqualify any individual deemed to be (i) tampering or attempting to tamper with the entry process or the operation of the Sweepstakes, including tampering with the Administrator’s websites; or (ii) acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Administrator may, in such case and at its sole discretion, proceed with the Sweepstakes using all non-suspect eligible entries. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE ADMINISTRATOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW. Failure by the Administrator to enforce any provision of these Official Rules will not constitute a waiver of that provision. In the event of a dispute as to the identity of a winner based on an email address, such winning entry will be declared won by the authorized account holder of the email address submitted at time of entry. "Authorized account holder" is defined as the natural person who is assigned an email address by an Internet access provider, on-line service provider or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address.

RELEASE AND LIMITATIONS OF LIABILITY: By participating in the Sweepstakes, entrants release and hold harmless the Administrator, The Carnegie Hall Corporation, The Carnegie Hall Society, Inc., and their respective employees, officers, trustees, affiliates, contributors and agents (collectively, the “Released Parties”) from and against any claim or cause of action, and any and all liability for any injuries, death or losses or damages to persons or property arising out of participation in the Sweepstakes or receipt or use of any prize, including, but not limited to: (a) any technical errors that may prevent an entrant from submitting an entry; (b) unauthorized human intervention in the Sweepstakes; (c) errors in the administration of the Sweepstakes or the processing of entries; (d) any changes in third party terms of conditions; (e) injury, death, or damage to persons or property which may be caused, directly or indirectly, in whole or in part, by entrant’s participation in the Sweepstakes or its related activities; (f) the acceptance, possession, use or misuse of, or any harm resulting from the acceptance, possession, use or misuse of, the Prize(s); and (g) violation of intellectual property or publicity rights, and/or invasion of privacy that may arise from participating in this Sweepstakes or its related activities. Released Parties assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. Released Parties are not responsible for any problems or technical malfunction of any telephone network or telephone lines, computer on-line systems, servers, or providers, computer equipment, software, failure of any email or entry to be received by Administrator or any other party on account of technical problems, human error or traffic congestion on the Internet or at any Website, or any combination thereof, including any injury or damage to entrant's or any other person's computer relating to or resulting from participation in this Sweepstakes or downloading any materials connected to this Sweepstakes. Each entrant further agrees that in any cause of action, the Released Parties’ liability will be limited to the cost of entering and participating in the Sweepstakes, and in no event will the Released Parties be liable for attorney’s fees.

GENERAL: By accepting a prize, each Winner grants to the Released Parties and those acting pursuant to the authority of Administrator and the Released Parties (which grant will be confirmed in writing upon Administrator's request), where permitted by law, the right to print, publish, broadcast, display or otherwise use worldwide IN ALL MEDIA, without limitation and at any time, such Winner’s full name, portrait, picture, voice, likeness and/or biographical information for advertising, trade and promotional purposes, without payment or additional consideration from Administrator, and without such Winner's review, approval or notification. IN NO EVENT WILL RELEASED PARTIES BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND (INCLUDING WITHOUT LIMITATION, DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES) ARISING OUT OF PARTICIPATION IN THIS SWEEPSTAKES OR THE ACCEPTANCE, POSSESSION, USE, OR MISUSE OF, OR ANY HARM RESULTING FROM THE ACCEPTANCE, POSSESSION, USE OR MISUSE OF THE PRIZES, AND ENTRANT WAIVES THE RIGHT TO SEEK SUCH DAMAGES. Winners acknowledge that Released Parties have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, relative to any of the Prizes.

USE OF DATA: All information submitted by entrants will be treated according to Administrator’s privacy policy, available at https://www.carnegiehall.org/privacy-policy. By participating in the Sweepstakes, each entrant agrees that (a) such entrant has read and accepted Administrator’s privacy policy, and (b) such entrant consents to Administrator's collection and usage of information or any data submitted or generated by, or in connection with, such entrant's participation in the Sweepstakes.

DISPUTES: Except where prohibited, each entrant agrees that any and all disputes, claims and causes of action arising out of, or connected with, the Sweepstakes or any prize awarded will be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the State of New York. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrants' rights and obligations, or the rights and obligations of Administrator in connection with the Sweepstakes, will be governed by, and construed in accordance with, the laws of the State of New York.
